Acceptance of Terms

Agreement to Terms

•By accessing or using WritePanda.ai ("Service"), you agree to be bound by these Terms of Service
•If you disagree with any part of these terms, you may not access the Service
•These terms apply to all visitors, users, and customers of the Service
•You must be at least 13 years old to use this Service
•If you are using the Service on behalf of an organization, you agree to these terms on behalf of that organization

Changes to Terms

•We reserve the right to modify these terms at any time
•We will notify users of material changes via email or in-app notification
•Continued use of the Service after changes constitutes acceptance
•You are responsible for reviewing these terms periodically

Account Terms

Account Creation

•You must provide accurate and complete information
•You are responsible for maintaining account security
•You must not share your account credentials
•One person or legal entity may maintain no more than one free account
•You are responsible for all activity under your account

Account Requirements

•You must be a human. Accounts registered by bots are not permitted
•You must provide a valid email address
•Your login may only be used by one person
•You must not use the Service for any illegal purposes
•You must comply with all applicable laws and regulations

Service Usage

Permitted Use

•Create and edit video content for personal or commercial use
•Generate AI-powered scripts, titles, descriptions, and thumbnails
•Process and transcribe videos using our AI tools
•Create AI clips and shorts from your content
•Publish content to YouTube via our integration
•Store content within your subscription limits
•Use generated content for your YouTube channel or other platforms

Service Limitations

•Video processing limited by subscription tier (60min/300min/unlimited)
•AI generation limits based on plan (scripts, thumbnails, clips)
•Storage limits based on plan (10GB/100GB/500GB)
•Export quality restricted by tier (720p/1080p/4K)
•Team seats limited to Business plan (5 users)
•API access restricted to Business tier

Fair Use Policy

•Service must not be used to overload our systems
•Automated or bulk operations must respect rate limits
•Content must not violate copyright or intellectual property rights
•No reselling or redistributing Service access
•Usage must align with intended purpose of content creation

Prohibited Uses

You May Not

•Use the Service for any illegal or unauthorized purpose
•Upload or generate content that infringes on intellectual property rights
•Create content that is defamatory, offensive, or harmful
•Upload malicious code or attempt to compromise the Service
•Reverse engineer, decompile, or disassemble the Service
•Use the Service to spam, phish, or engage in fraudulent activities
•Resell, redistribute, or sublicense the Service
•Violate any laws in your jurisdiction
•Upload content containing personal information of minors
•Generate misleading or deceptive content

Payment Terms

Subscription Plans

•Creator Plan: $19/month or $15/month (annual)
•Professional Plan: $49/month or $39/month (annual)
•Business Plan: $99/month or $79/month (annual)
•7-day free trial available for new users
•All plans auto-renew unless cancelled

Billing

•Payment processed securely via Stripe
•Subscription fees are billed in advance
•All fees are in USD unless otherwise stated
•Taxes may apply based on your location
•You authorize us to charge your payment method on a recurring basis

Refunds and Cancellations

•Cancel anytime through your account settings
•Cancellation takes effect at the end of the current billing period
•No refunds for partial months or unused features
•Downgrading takes effect at the next billing cycle
•We may offer discretionary refunds on a case-by-case basis

Intellectual Property

Your Content

•You retain all rights to content you upload
•You grant us a license to process and store your content
•You are responsible for ensuring you have rights to uploaded content
•AI-generated content based on your input belongs to you
•You may use generated content for commercial purposes

Our Property

•The Service, including all software and design, is owned by Sanklad Digital Ltd
•WritePanda name, logo, and branding are our trademarks
•You may not copy, modify, or distribute our software
•Templates and system-generated content structures remain our property
•Feedback and suggestions become our property

Privacy and Data

Data Processing

•We process your data according to our Privacy Policy
•Your content is stored securely on AWS and Cloudflare infrastructure
•AI processing is performed by trusted third-party providers
•We do not sell your personal information
•You can request data deletion through account settings

Third-Party Services

•YouTube integration requires separate acceptance of YouTube Terms
•Payment processing handled by Stripe under their terms
•AI services provided by Anthropic (Claude), Deepgram, and Sieve.ai
•Cloud storage via AWS S3 and Cloudflare R2
•Analytics may be collected for service improvement

Limitation of Liability

Service Warranty

•Service is provided "as is" without warranties of any kind
•We do not guarantee uninterrupted or error-free service
•We are not responsible for content you create or publish
•AI-generated content may contain errors or inaccuracies
•We do not guarantee specific results or outcomes

Liability Limits

•Our liability is limited to the amount paid for the Service
•We are not liable for indirect, incidental, or consequential damages
•We are not responsible for loss of profits or data
•You indemnify us against claims arising from your use
•Some jurisdictions do not allow liability limitations

Termination

Termination by You

•You may cancel your account at any time
•Cancellation can be done through account settings
•Access continues until end of billing period
•Data may be deleted 30 days after termination

Termination by Us

•We may terminate for violation of these terms
•We may terminate for non-payment
•We may discontinue the Service with 30 days notice
•Termination for cause is effective immediately
•We will attempt to notify you before termination

Governing Law

Jurisdiction

•These terms are governed by the laws of the United Kingdom
•Disputes shall be resolved in the courts of England and Wales
•You consent to the jurisdiction of these courts
•The UN Convention on International Sale of Goods does not apply

Contact Information

Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Sanklad Digital Ltd regarding the use of WritePanda.ai. These terms supersede any prior agreements or understandings.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be replaced with a valid provision that comes closest to the intent of the original.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorized representative of Sanklad Digital Ltd.
